Design & Construct Professional Indemnity Insurance
The risk in focus
Design and construct professional indemnity insurance addresses defined professional services exposures where a contractor designs, specifies, advises, certifies or assumes design responsibility. It needs to be checked alongside public liability and contract works rather than treated as an automatic extension of either.
Where design responsibility can arise
In-house design, subcontracted consultants, temporary works, design coordination, certification, performance specifications, novated consultants and collateral warranties can each create different obligations. For insurance assessment, describe who performs each professional service and the insurance requested by the customer. Your legal adviser should interpret any allocation of duties in the contract.
Policy and contract questions
Examine the definition of professional services, fitness-for-purpose obligations, contractual liability exclusions, subcontracted consultant cover, retroactive date, prior-known-circumstances provisions, territorial and jurisdiction limits, defence costs, aggregate limits and any run-off requirements. PI is generally claims-made, so the timing of notification matters.
